These Terms of Service ("Terms") govern your use of the Finesse closed-alpha build, the Finesse launcher, the playfinesse.gg website, and any related services (collectively, the "Services") provided by GamerFrame ("we," "us," "our").
You must be at least 18 years of age to use the Services. The Finesse closed alpha is restricted to adults; we do not permit testers under 18 regardless of parental consent or any other qualification. False attestation of age is a material breach and results in immediate access termination.
You must reside in the United States, Canada, Mexico, or the Dominican Republic. The Finesse closed alpha (v1.0) is geographically scoped to those jurisdictions. The cohort may expand in future alpha versions; this restriction applies to the current v1.0 closed-alpha period only. False attestation of residence is a material breach and results in immediate access termination.
You must have been invited to the closed alpha and have accepted the Non-Disclosure Agreement (NDA). Without an invitation + NDA acceptance, you have no rights to use the Services.
Age and residence are attested at three points: NDA acceptance, Discord onboarding, and acceptance of these Terms. By using the Services, you reaffirm both attestations.
For the closed alpha, your "account" is your Discord identity used to access the alpha server.

When you submit content through the Services (feedback, bug reports, in-game chat, etc.), you grant us a non-exclusive, royalty-free, worldwide license to:
You retain ownership of your content. We won't claim it as ours; we just need permission to use it for development.
The Finesse name, logo, game mechanics, art, music, code, characters, world, lore, and all related materials are owned by GamerFrame. Your access to the alpha grants you a personal, limited, non-transferable license to play the build for testing purposes only.

The Game is currently free to play during closed alpha. Once paid features or transactions launch, we will publish separate payment terms covering pricing, refunds, taxes, and currency conversion. The terms in this section currently apply only to voluntary contributions made to support the development of the Game.
You may make voluntary monetary contributions ("contributions" or "support payments") to GamerFrame LLC through the Service or through third-party payment platforms (such as Stripe) that we authorize. All contributions are voluntary. You are not required to contribute to access any part of the Service, and contributions do not entitle you to any specific goods, services, rewards, equity, alpha access, or other consideration unless explicitly stated at the point of payment.
GamerFrame LLC is a for-profit limited liability company. We are not a 501(c)(3) tax-exempt organization. Contributions are not tax-deductible as charitable donations under U.S. federal income tax law. We do not provide tax-deduction receipts.
Contributions are non-refundable except (a) as required by applicable consumer protection law, (b) in the case of a duplicate or accidental charge that we verify, or (c) at our sole discretion. To request a refund within these limits, email support@playfinesse.gg within 30 days of the contribution.
If you are a consumer resident in the European Economic Area (EEA) or the United Kingdom, you may have a 14-day right of withdrawal under the EU Consumer Rights Directive (Directive 2011/83/EU) for distance contracts involving the supply of digital content. By making a voluntary contribution where no digital content, goods, or services are delivered in exchange, you acknowledge that this right does not apply, as no contract for the supply of digital content has been formed. Where digital content or services are delivered as a reward for a contribution, you expressly consent to immediate performance and acknowledge that you waive your right of withdrawal as permitted by Article 16(m) of the Directive.
If you believe a contribution was made in error, contact us first at support@playfinesse.gg. Initiating a chargeback through your card issuer or bank without first contacting us may result in additional review and may affect your ability to make future contributions through GamerFrame LLC.
Contributions are processed by third-party platforms (e.g., Stripe, Inc., available at stripe.com). Your use of those platforms is governed by their respective terms of service and privacy policies. We are not responsible for the actions, omissions, or policies of third-party payment processors except as required by law.
Contributions are denominated in U.S. dollars (USD) unless otherwise specified at the point of payment. Currency conversion fees, foreign transaction fees, or other charges imposed by your card issuer or bank are your responsibility.
When paid features (such as cosmetics, expansions, memberships, or in-game commerce) launch, separate payment terms will apply and supersede this Section 6 with respect to such transactions. Voluntary contribution terms in this Section 6 will continue to apply to any contribution flow that remains gift-based.
We may terminate or suspend your access to the Services at any time, for any reason, without prior notice. Common reasons include:
Upon termination, your right to use the Services ends immediately. The NDA you signed remains in effect per its own terms (until version 1.0 release or 2 years from signing).
This limitation does not apply where prohibited by law (e.g., consumer protection laws in some jurisdictions may override this).
You agree to indemnify and hold GamerFrame harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from:
These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of California, with venue in Sacramento County. GamerFrame is a California limited liability company.
We may update these Terms from time to time. Material changes will be posted at playfinesse.gg/terms and announced in the alpha Discord. Continued use after changes constitutes acceptance.
These Terms, together with the NDA and Privacy Policy, constitute the entire agreement between you and us regarding your participation in the Finesse closed alpha.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
