This page is a reference copy of the closed-alpha NDA. The binding acceptance happens inside the alpha Discord server via the ✓ reaction on the pinned message in #nda-acceptance. This page exists so testers who have already accepted can re-read the terms (since the Discord channel is hidden post-acceptance per server compartmentalization).

Plain-language summary (the parts that matter)

You're being given early access to Finesse, a high-skill PvP melee combat game in pre-release development. By accepting this agreement, you're agreeing to:

1. You are 18 years of age or older. Finesse closed alpha is restricted to adults.
2. You reside in the United States, Canada, Mexico, or the Dominican Republic. The v1.0 cohort is scoped to North America.
3. Not share the game binary, launcher, or installer with anyone outside the alpha cohort.
4. Not post screenshots, gameplay footage, recordings, or streams publicly until Finesse reaches version 1.0 and beyond (version 1.0 or any later version released publicly).
5. Not publicly share bug reports or feedback you submit in the alpha Discord.

You're free to do all of the following:

• Discuss the existence of the game ("yeah I'm in a PvP alpha")
• Describe the game in general terms ("it's a deep PvP melee combat game")
• Send praise or criticism in vague terms
• Share that you're testing it (without specifics)

This agreement auto-expires when EITHER:

• Finesse reaches version 1.0 and beyond — that is, version 1.0 or any later version is released publicly to anyone outside the alpha — OR
• Two (2) years pass from your acceptance date,

whichever comes first. Once it expires, you're free to share whatever you want about the alpha period (including footage, screenshots, archived feedback).

If you violate this agreement before it expires, your access to the alpha will be terminated and you may be removed from future development cohorts. No other penalties unless your violation causes documented harm.

Full agreement text

This Non-Disclosure Agreement ("Agreement") is between GamerFrame ("Developer," "we," "us") and the individual who accepts this agreement ("Tester," "you").

1. Definitions

• "Confidential Material" means: (a) the Finesse game binary, launcher, installer, and any files distributed through the Tester program; (b) screenshots, recordings, video footage, livestreams, or other visual reproductions of the Finesse alpha build; (c) bug reports, feedback, or other communications you submit through Finesse alpha channels.
• "Alpha Cohort" means individuals who have been invited to and have accepted this Agreement.
• "Version 1.0 and Beyond" means the public release of Finesse at version 1.0 or any later version (for example, 1.x, 2.0, or any subsequent release) made available to individuals outside the Alpha Cohort. The public release of version 1.0 begins the "1.0 and beyond" period; that period continues for every version released thereafter.

1.5 Age requirement

You confirm that you are at least eighteen (18) years of age at the time of accepting this Agreement. The Finesse closed alpha is restricted to adults; testers under 18 are not eligible to participate regardless of any other qualifications. False attestation of age is a material breach of this Agreement and will result in immediate termination of access plus removal from all current and future Finesse development cohorts.

1.6 Geographic eligibility

The Finesse closed alpha (versions 0.1xx through 0.9xx, pre-1.0) is open to residents of: the United States, Canada, Mexico, and the Dominican Republic. By accepting this Agreement you confirm that you reside in one of those jurisdictions. The geographic cohort may expand in future alpha versions; this restriction applies to the current v1.0 closed-alpha period only. False attestation of residence is a material breach of this Agreement and will result in immediate termination of access plus removal from all current and future Finesse development cohorts.

2. Confidentiality obligations

During the term of this Agreement, you agree NOT to:

• Distribute, share, lend, or otherwise transfer the Confidential Material to anyone outside the Alpha Cohort
• Publish, post, upload, stream, broadcast, or otherwise make Confidential Material publicly available, including but not limited to: YouTube, Twitch, Twitter/X, TikTok, Reddit, public Discord servers outside the alpha, personal websites, or any other public-facing platform
• Reverse engineer, decompile, or attempt to extract source code from the Confidential Material

3. Permitted activities

This Agreement does NOT restrict you from:

• Disclosing your participation in the Finesse closed alpha (in general terms)
• Describing the game in vague terms (genre, basic gameplay style, general impressions)
• Discussing the game's existence with anyone, including potential future testers
• Sharing the public-facing materials Developer has released (trailers, store page text, marketing screenshots)
• Submitting feedback or bug reports through Developer's official alpha channels

4. Term and termination

This Agreement enters effect upon your acceptance and remains in effect until the earliest of the following:

• (a) Finesse reaches version 1.0 and beyond — i.e., version 1.0 or any later version is released publicly to anyone outside the Alpha Cohort — OR
• (b) Two (2) years from your acceptance date, OR
• (c) Developer formally terminates this Agreement in writing or via the alpha Discord

Upon any of the above, the confidentiality obligations in Section 2 terminate completely. You are then free to share, post, archive, or otherwise distribute any Confidential Material you possess from the alpha period.

5. Remedies for breach

If you violate this Agreement before its termination, Developer may:

• Immediately terminate your access to the Finesse alpha
• Remove you from current and future Finesse development cohorts
• Pursue other remedies available under applicable law if your breach causes documented financial or reputational harm to Developer

Developer's primary remedy is access termination. Litigation is reserved for cases of intentional, malicious breach causing demonstrable harm.

6. No grant of rights

This Agreement grants you a limited, revocable, non-transferable license to access and play the Finesse alpha build solely for personal testing purposes. You acquire no ownership, intellectual property, or other rights in Finesse or any Confidential Material.

7. No warranty

The Finesse alpha build is provided "as is" without warranty of any kind. Developer makes no representation that the alpha will be free from bugs, errors, crashes, data loss, or other defects. You participate at your own risk.

8. Jurisdiction

This Agreement is governed by the laws of the State of California, United States and any disputes shall be resolved in the courts of that jurisdiction. GamerFrame is a California limited liability company; venue lies in Sacramento County, California.

9. Entire agreement

This document constitutes the entire agreement between the parties regarding the Finesse closed alpha and supersedes any prior verbal or written agreements on the same subject.

10. Acceptance

By clicking "I agree" on the alpha Discord, or by otherwise affirmatively indicating acceptance (e.g., reaction-roll, signed reply), you confirm that:

1. You are at least 18 years old (see Section 1.5)
2. You reside in the United States, Canada, Mexico, or the Dominican Republic (see Section 1.6)
3. You have read, understood, and agree to be bound by this Agreement
4. Your acceptance is voluntary and not coerced
